1. Licence to use the app

We grant you a personal, non-exclusive, non-transferable, revocable licence to install and run Focus Wall on computers you own or control, for non-commercial or internal business use. You may not:

• Redistribute, resell, sublicense, or rent the app to third parties
• Reverse-engineer, decompile, or disassemble the app, except where that restriction is prohibited by law
• Remove or obscure any copyright, trademark, or licence notices
• Use the app for any unlawful purpose, or in a way that infringes the rights of others
• Share, transfer, or publish your licence key, or use one licence key on more devices than your plan allows

This is a licence, not a sale. We retain all intellectual-property rights in the app.

2. Free tier and Pro plan

Focus Wall is free to download and use with a limited feature set. The Pro plan unlocks additional features (unlimited sites, scheduling, Google Calendar sync, Pain Tax, and future Pro-only features) and is sold as a recurring subscription:

• Monthly plan: USD $5 per month, billed monthly in advance
• Annual plan: USD $36 per year, billed annually in advance

Prices are shown in US dollars and do not include any sales tax, VAT, or GST that may apply in your jurisdiction. We may change the price of the Pro plan at any time; any change will apply only to renewals after you have been notified, never to your current paid term.

3. Billing and automatic renewal

All payments are processed by Stripe. By subscribing you authorise us to charge your chosen payment method for the plan you select, and to automatically renew that charge at the start of each billing period (monthly or annual) until you cancel. You can cancel any time from the customer portal linked in your purchase-confirmation email or from the app's Account tab.

If a renewal charge fails we may retry, suspend your Pro features until the payment succeeds, and, if it continues to fail, cancel your subscription.

4. Pain Tax — the opt-in commitment device

Pain Tax is an opt-in feature in which you voluntarily agree, in advance, that Focus Wall may charge a self-selected amount (between USD $2 and USD $50) to your saved payment method each time you lift a block outside the conditions you have configured. This is a commitment device you set up against your own future behaviour.

The following rules apply to Pain Tax and form part of these Terms:

• Pain Tax is never enabled by default. It requires an explicit opt-in and the addition of a saved payment method via Stripe.
• Before any Pain Tax charge is processed, the app displays a confirmation modal showing the exact amount and the last four digits of the card to be charged. You must click "Pay and continue" to authorise the charge. If you click "Stay focused" the block is not lifted and no charge occurs.
• You can disable Pain Tax and remove your saved payment method at any time from the Pain Tax tab in the app. Disabling applies immediately to future lifts; charges that have already been authorised are final.
• Pain Tax charges represent a service fee for lifting a restriction that you previously asked us to enforce. They are non-refundable except as required by applicable consumer law, or where a charge was processed in error (for example, due to a bug or unauthorised access to your device).
• You are solely responsible for configuring Pain Tax amounts at levels you can afford. We strongly suggest starting at USD $2 and raising only after you've used the feature for at least a week.

By enabling Pain Tax you confirm that you are at least 18 years old, that the payment method is lawfully yours, and that you understand you are authorising real monetary charges to occur based on your own in-app actions.

5. Refund policy

Pro subscriptions. If you are unhappy with the Pro plan within the first 14 days of your initial purchase, email us at the address below and we will refund that purchase in full, no questions asked. After 14 days, Pro subscriptions are non-refundable but you can cancel at any time to stop future renewals. Annual plans renewed after the first year are not covered by the 14-day window, but may be refunded at our discretion if you cancel within 14 days of that renewal and have not used Pro features during the renewed period.

Pain Tax charges. Pain Tax charges are service fees and are non-refundable, except where required by applicable consumer-protection law or where a charge was processed in error as described in section 4. If you believe a Pain Tax charge was processed in error, email us within 30 days and we will investigate and, if appropriate, refund.

Nothing in this policy is intended to limit any non-excludable statutory rights you may have, including any consumer-law rights in your jurisdiction.

6. Your account and licence key

After you purchase Pro, Stripe sends you a licence key by email. Enter it in the Account tab of the app to activate Pro features. Keep the key private: anyone with the key can activate Pro on another device. If your key is compromised, email us and we will revoke and reissue it.

7. Google Calendar integration

The optional Google Calendar integration is governed by these Terms and by our Privacy Policy. Focus Wall's use and transfer to any other app of information received from Google APIs adheres to the Google API Services User Data Policy, including the Limited Use requirements. You can revoke access at any time from the app's Calendar tab or from your Google Account permissions page.

8. System modifications (hosts file)

To block websites across every browser simultaneously, Focus Wall modifies your operating system's hosts file within clearly delimited Focus Wall markers. The app requests elevated (administrator / sudo) permission when needed for this. When you quit or uninstall Focus Wall, the entries between our markers are removed. We do not touch hosts-file entries outside our markers. You agree that you understand and consent to this system-level modification.

9. No warranty

The app is provided "as is" and "as available", without warranty of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, non-infringement, or uninterrupted operation. We do not warrant that the app will be error-free, that every block will succeed against every evasion technique, or that Google Calendar or Stripe will be available at any given moment.

10. Limitation of liability

To the maximum extent permitted by law, Sandy Intelligence Inc.'s total aggregate liability to you for any claim arising out of or in connection with the app or these Terms is limited to the greater of (a) USD $50 or (b) the total amount you paid us in the 12 months immediately preceding the event giving rise to the claim. We are not liable for any indirect, incidental, special, consequential, or punitive damages, including lost profits, lost productivity, or data loss. Nothing in this section limits liability that cannot be limited under applicable law (including liability for gross negligence, fraud, or personal injury caused by negligence).

11. Termination

You may terminate these Terms at any time by uninstalling the app and (if applicable) cancelling your Pro subscription. We may suspend or terminate your licence if you materially breach these Terms (for example, by sharing your licence key or attempting to reverse-engineer the app). Sections that by their nature should survive termination (for example, limitation of liability and governing law) will survive.

12. Changes to these Terms

We may update these Terms from time to time. The "Last updated" date at the top of this page will change and material changes will be announced in the app before they take effect. Continued use of the app after changes take effect means you accept the new Terms. If you do not accept them, stop using the app and cancel any subscription.

13. Governing law

These Terms are governed by the laws of the Province of Ontario, Canada, and the federal laws of Canada applicable therein, without regard to conflict-of-law principles. The courts located in Toronto, Ontario have exclusive jurisdiction over any dispute arising out of or relating to these Terms, except that either party may seek injunctive relief in any court of competent jurisdiction to protect its intellectual-property rights.
